Find a Teacher: Terms of Use
The Royal Conservatory of Music maintains this website (the Site) for your personal information and educational use only. The Site provides data and other information that include articles, publications, images, video, audio, and other materials (collectively, the Content) on music and arts education in Canada as well as services such as examination scheduling (collectively, the Services).

By accessing or using the Site, you agree to be bound by the Terms of Use.  Any breach of the Terms of Use by you immediately terminates your right to access the Site, the Content, and Services.
 

Data Collection

You consent to have your contact information and the conversation entered in the Contact Form recorded and stored on our servers in according to the Site’s Privacy Policy. Messages sent and received through the “Find a Teacher” feature are accessible to The Royal Conservatory personnel. However, we are not responsible for monitoring or facilitating any activity or communications in “Find a Teacher.” We may use the information received in “Find a Teacher” to produce marketing reports, measure analytics, investigate violations of or enforce this Agreement, or to protect the rights and property of The Royal Conservatory, its partners, and customers. If you are aware or experience any violation of this Code by another user, you should report them immediately, using our "Report an Issue” tool. We are not liable for any violation of this agreement by you or by any other “Find a Teacher” user.
 

Age Restriction

You must be at least 16 years of age to contact an individual on the Site’s “Find a Teacher” feature. If you are under 16 years old, your parents/guardians must contact the individuals and be involved in the conversations on your behalf.
 

Code of Conduct

In order to keep the “Find a Teacher” feature on this Site safe for everyone, it is important for all users to respect the rights of others and refrain from misuse of "Find a Teacher.” Accordingly, when you contact a teacher, you agree that you will follow the rules set forth below:
  • Do not send hate messages or use or promote hate speech.
  • Do not threaten, harm, bully, harass, troll, or stalk anyone.
  • Do not share content or communication that is racist or offensive to any ethnicity, gender identity, sexual orientation, nationality, or religion, or that disparages anyone based on their mental or physical ability, appearance, or other personal trait.
  • Do not share content or communication that is lewd or contains graphic sexual content or abhorrent violent material.
  • Do not engage in, threaten, or promote illegal activity, terrorism, or acts of violence or self-harm.
  • Do not defame or spread lies about anyone.
  • Do not share any content that contains any viruses, worms, spyware, time bombs, or other computer programs that may damage, interfere with, or disrupt ”Find a Teacher” feature.
  • Do not send SPAM, or upload or share content that is commercial in nature, such as advertisements, solicitations, promotions, and links to web sites unrelated to your teaching practice.
  • Do not engage in, promote, or facilitate activities that infringe on the rights of any third party, or violates any law or regulation, or contractual or fiduciary obligations.
  • Do not steal anyone’s identity, impersonate anyone, or engage in fraudulent, deceptive, or misleading practices.
  • Do not submit false technical or teacher issue reports or otherwise abuse the "Report an Issue” system.
  • Do not abuse, threaten, or be rude to our employees, agents or representatives. If you do, in addition to any other actions we may take under this Agreement, we may restrict you from contacting us by email or refuse to provide you with any further support.
  • Violations of our Code of Conduct may result in moderation action taken against you. We may also notify law enforcement (or another appropriate government agency) if the breach involves a threat to the life or safety of yourself or others, or any other activity that we believe to be unlawful.

Safety

The Royal Conservatory created “Find a Teacher” to help parents and students find music teachers and to promote The Royal Conservatory music program. You do not need to have an account to contact a teacher on this Site. You do need to submit personal information such as your name and email address in order to initiate a conversation with a teacher. While The Royal Conservatory is proud of its teacher community, teacher profiles on the Site are not reviewed before going live. The Royal Conservatory is not responsible for the accuracy of the information shared by teachers. To protect yourself, we recommend that you do due diligence similar to finding a music teacher in person when using our services.

Please take the following precautions while using “Find a Teacher”:
  • Research a teacher thoroughly before committing to receive lessons and materials from them.
  • Be wary of emails asking you to confirm your account or a password or email address change that was not requested. These are very often phishing emails by scammers trying to gain access to your account. Any emails we send requiring you to log in will bring you directly to our site. The Royal Conservatory sign in page should always show up as being secure in your web browser.
  • Do not give out personal or banking information (e.g. social insurance number, bank account number) over the Internet.
  • Inform The Royal Conservatory of any attempted fraud or suspicious emails, ads, or other activity by community members using the “Report an Issue” feature located on the teacher’s profile.

Registration

To access certain areas of the Site, we require you to register with us. Registration is free and allows you to access Content and Services not available to unregistered visitors. By registering, you certify that the information you provide in the registration form is accurate. Any personal information you provide in the registration form will be collected in accordance with, and for the express purposes set out in the Privacy Policy.


Your Account With Us

We reserve the right to disable your user account at any time, including if you have failed to comply with any of the provisions of these Terms, or if activities occur on your account which, in our sole discretion, would or might cause damage to or impair the Services or infringe or violate any third party rights, or violate any applicable laws or regulations.


Your Access to and Use of Our Services

We reserve the right, at any time and without prior notice, to remove or disable access to content at our discretion for any reason or no reason. Some of the reasons we may remove or disable access to content may include finding the content objectionable, in violation of these Terms or our Community Policy, or otherwise harmful to the Services or our users.


Termination

We reserve the right to temporarily or permanently suspend or terminate your user account or impose limits on or restrict your access to parts or all of the Services with or without notice at any time for any or no reason including: 
  • if we reasonably believe you violate, or we have objective grounds to reasonably believe you are about to violate, the Terms, including any incorporated agreements, policies or guidelines (such as our Code of Conduct), or any applicable laws or regulations; 
  • if activities occur on your account which, in our sole discretion, would or might cause damage to or impair us or our Services or infringe or violate any third party rights (including intellectual property rights); 
  • in response to requests by law enforcement or other government agencies under valid legal process; 
Subject to any statutory rights you might have, if your account is temporarily or permanently suspended or terminated, access to your username, password, and any related information or content associated with your account may be suspended or terminated.


Site Content

The Content provided on the Site is and remains at all times the property of The Royal Conservatory or its licensors or suppliers. All names, marks, logos and other identifications of The Royal Conservatory are the property of The Royal Conservatory or its licensors or suppliers and all rights are reserved.
You should assume that everything you see or read on the Site may not be used except as provided in these Terms and Conditions or in the text on the Site without the written permission of The Royal Conservatory.

You may access and view the Site and Content and make use of the Services solely for your own personal, non-commercial use. No whole or part of the Content may be otherwise used for any purpose whatsoever without express written approval of The Royal Conservatory prior to each use.
Except as set forth above, you may not republish, copy, reproduce, transmit, frame, hyperlink, upload, post or distribute in any way, or create derivative forms of this Content. Modification of Content, use of Content for any other purpose, or use of Content on any other website or network computer is strictly prohibited.

We, or authorized third parties, reserve the right to cut, edit, or refuse to publish your content at our or their sole discretion. We have the right to remove, disallow, block or delete any posting you make on our Site if, in our opinion, your post does not comply with the content standards set out in these Terms. In addition, we have the right – but not the obligation – in our sole discretion to remove, disallow, block or delete any User Content that we consider to violate these Terms, or in response to complaints from other users or third parties, with or without notice and without any liability to you.


Submissions

By submitting content and/or information to The Royal Conservatory via the Site, you hereby grant a transferable world-wide perpetual, irrevocable, royalty-free, non-exclusive license to such content and information. This includes the right to sublicense to others and to use or reproduce, distribute, publish, modify, edit, translate, transmit, adapt, incorporate into other works or otherwise use the content and information provided by you and/or incorporate such content and information in any form, media or technology now known or developed in the future, with no compensation of any kind. You waive in favor of The Royal Conservatory all moral rights in such content and information. By submitting content and/or information to The Royal Conservatory, you represent and warrant that you have the full right and authority to do so and that any use by The Royal Conservatory of the content and information will not violate the intellectual property rights of any person.


Purchases of Print Music Resources

The price for print music resources on the Site may differ from the price shown in a user's shopping cart - it is possible that such price may increase or decrease between the time the item is placed in a shopping cart and the time that the purchase is actually made. On rare occasions, an item may be priced incorrectly on the Site. If the price for the item on the Site is incorrect and is actually higher than the price provided at the time of purchase, then, its sole discretion, The Royal Conservatory may either (i) contact the user for instructions before shipping the item or charging the user for such item; (ii) cancel the order for such item and notify the user of such cancellation; or (iii) ship the item at the incorrect price to the benefit of the user.

The risk of loss and title for all items purchased via the Site pass to the user upon delivery of the item to the carrier.


Links

The Site may contain links to third party websites. We provide access to third party websites as a convenience to you. The Royal Conservatory does not endorse the content contained in any third party website. We shall not be held responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any third party website, and we do not make any representations, warranties and conditions, express or implied, including, without limitation, implied warranties of title, non-infringement, accuracy, merchantability, and fitness for a particular purpose. The Royal Conservatory does not make any representation, warranty or condition, implied or statutory that the operation of any third party website will be uninterrupted, free of error, viruses or any other harmful components. The content, goods and/or services available on or through any third party website is not under The Royal Conservatory's control and if you choose to access any third party website, you do so entirely at your own risk.


Exclusion of Warranties

We may change, suspend, withdraw or restrict the availability of all or any part of our platform for business and operational reasons at any time without notice

THIS SITE, THE CONTENT, THE SERVICES, AND ANY PRINT MUSIC RESOURCE OBTAINED THROUGH THIS SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, THE ROYAL CONSERVATORY AND ITS SUPPLIERS DISCLAIM ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, ACCURACY, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. THE ROYAL CONSERVATORY DOES NOT MAKE ANY REPRESENTATION, WARRANTY OR CONDITION, IMPLIED OR STATUTORY THAT THE OPERATION OF THE SITE WILL BE UNINTERRUPTED, FREE OF ERROR, VIRUSES OR ANY OTHER HARMFUL COMPONENTS.


Limitation of Liability

NEITHER THE ROYAL CONSERVATORY NOR ANY OF OUR AFFILIATES, LICENSORS, SUPPLIERS, AND EACH OF THEIR DIRECTORS, OFFICERS, AGENTS, CONTRACTORS, PARTNERS, EMPLOYEES, LICENSORS, AND SUPPLIERS, ARE RESPONSIBLE OR LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE OR OTHER DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS, LOSS OF DATA OR LOST PROFITS), UNDER ANY LEGAL THEORY ARISING OUT OF OR RELATING IN ANY WAY TO THIS SITE AND/OR CONTENT OR PRINT MUSIC RESOURCES OR SERVICES OR ANY LINKED SITE. YOU ACKNOWLEDGE THAT IF NO FEES ARE PAID BY YOU TO THE ROYAL CONSERVATPRY TO ACCESS THIS SITE OR FOR A PRINT MUSIC RESOURCE, YOU SHALL BE LIMITED TO INJUNCTIVE RELIEF ONLY, UNLESS OTHERWISE PERMITTED BY LAW, AND SHALL NOT BE ENTITLED TO DAMAGES OF ANY KIND FROM THE ROYAL CONSERVATORY, OUR AFFILIATES, LICENSORS, SUPPLIERS, AND EACH OF THEIR DIRECTORS, OFFICERS, AGENTS, CONTRACTORS, PARTNERS, EMPLOYEES, LICENSORS, AND SUPPLIERS, REGARDLESS OF THE CAUSE OF ACTION.
CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.


Indemnification

You agree, at your own expense, to indemnify, defend and hold The Royal Conservatory, its licensors and/or suppliers, and their respective directors, officers, employees, representatives, and agents harmless against any claim, suit, demand, action or other proceeding brought or threatened by a third party as a result of your breach of these Terms and Conditions.


Changes to Terms and Conditions

We reserve the right, in our sole discretion, to change, modify, add, or delete portions of these Terms and Conditions at any time without prior notice to you. If we do this, we will post the changes to these Terms and Conditions and will indicate at the top of that page the date these terms were revised. Your access to and use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.

We also reserve the right to add, delete, modify or amend features and/or services contained within the Site, to limit the availability of the Site, and/or to limit the provision of any content, service, or product described herein to any person, geographic area or jurisdiction, at any time and in our sole discretion, as well as to limit the quantities of any content, service, or product(s) that we may provide.


Miscellaneous

If any provision of these Terms and Conditions is found to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.

These Terms and Conditions, the Privacy Policy, the Bookstore Policies & Shipping terms, and if you are using Facebook to sign in, with respect to such sign in, the Facebook Documentation, represent the entire agreement between us relating to your right to access and use the Site and purchase print music resources via the Site, and supersede any and all prior or written or oral agreements between us with respect to such subject matter.
No waiver by The Royal Conservatory of any breach or default by you under these Terms and Conditions shall be deemed to be a waiver of any preceding or subsequent breach or default.

Any legal action concerning these Terms and Conditions shall be interpreted under the laws of the Province of Ontario and shall be subject to the exclusive jurisdiction of the province and federal courts located in Ontario, Canada.


Privacy Policy

OUR COMMITMENT

The Royal Conservatory is committed to respecting and protecting your privacy. We value you, and give you our assurance that we are committed to upholding the trust you've placed in us as one of Canada's oldest and largest cultural institutions. The Royal Conservatory's privacy policy ("Policy") outlines the collection, use, retention, management and disclosure of your personal information. Please note that "personal information" means any information about an identifiable individual, such as name, home address, home phone and fax numbers, email address, birth date, age, proof of age, and credit card information. This Policy follows the privacy principles set out in the federal government's Personal Information Protection and Electronic Documents Act (PIPEDA).

Please note that by visiting The Royal Conservatory's web site and/or by providing personal information to The Royal Conservatory, you accept the terms and practices described in this Policy, as amended from time to time.

The Royal Conservatory will keep this Policy up to date to ensure that it is relevant and remains current with changing laws, regulations and technologies. Please review this Policy in its entirety and revisit it for changes periodically. If we change the Policy in a material way, we will provide appropriate notice to you.


PRIVACY PRINCIPLES

Accountability

The Royal Conservatory is responsible for personal information under its control.


Identifying Purposes

The Royal Conservatory collects personal information primarily to register and communicate with students and candidates, fulfill ticket requests and process donations. This personal information may also be used for a variety of promotions, and to keep you informed of seasonal and special offers, other events and occasional fundraising opportunities in support of The Royal Conservatory. The Royal Conservatory may also occasionally contact you to conduct market research or surveys in an effort to continually improve our product and service offerings. However, it will be your choice as to whether to participate in any market research or survey of The Royal Conservatory. The Royal Conservatory may present offers in conjunction with other arts or cultural organizations if deemed to be of value to patrons. Personal information may be used in the collection and/or enforcement of payment of tuition and/or other fees to The Royal Conservatory. The Royal Conservatory does not engage in list exchanges, or allow personal information collected by The Royal Conservatory to be provided to any other organization.

The Royal Conservatory also uses personal information for its risk management and related purposes. Personal information may be disclosed by The Royal Conservatory for certain emergency and other purposes as permitted and/or required by applicable laws.

At any time, you may ask The Royal Conservatory to stop sending you email and/or other information by contacting us at [email protected], and any unsolicited email The Royal Conservatory sends to you will tell you how to decline further unsolicited email.

Like many other web sites, The Royal Conservatory's website automatically collects certain non-identifying information regarding web site users. The Royal Conservatory uses common Internet tracking tools associated with standard Internet protocols and web-based systems. This information is typically stored in log files. Log files are transaction records maintained by web servers and used for recording and reporting information, such as: service provider IP addresses, browser versions, referring web sites, search terms used, average number of web pages requested, most visited web pages, average duration of visit, peak traffic times and total visitor traffic. This aggregated information does not identify you and thus does not constitute personal information. We do not report on individual user sessions. We use aggregated information gathered from your visit for web site and system administration purposes in order to help the management of our systems and to better serve our users.

The Royal Conservatory website uses "cookies", a technology that installs information on a web site user's computer to permit the web site to recognize future visits using that computer. A cookie is generally used to enhance your browsing experience. Cookies do not give The Royal Conservatory access to any data or software on your hard drive. You can choose to set your browser to detect and reject cookies, to accept cookies from all sites, or to prompt you whenever a site wants to send you a cookie. Check your browser's "Help&" files to learn how to do this. If you choose to refuse cookies, you may not be able to access some of the interactive features on our web site and moving around The Royal Conservatory web site could be much slower.

The Royal Conservatory also uses the Google AdWords remarketing service to advertise on third party websites (including Google) to previous visitors to our site. This means that we might advertise to previous visitors to our site who haven't completed a task, for example using the National Teacher Directory search form to find a teacher. This could be in the form of an advertisement on the Google search results page, or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone's past visits to The Royal Conservatory's website. Any data collected will be used in accordance with our own privacy policy as well as that of Google.


Consent

By giving personal information to The Royal Conservatory, candidates, students, donors and customers consent to the use, retention and disclosure of personal information collected by The Royal Conservatory in accordance with this Policy. The Royal Conservatory will only use your personal information for the original purpose for which it was collected, and any new use of that information is subject to your consent. How we obtain your consent will depend on the circumstances and sensitivity of the information collected. For sensitive information, such as credit card information, your express consent to the use of such information will be requested. For certain uses of less-sensitive personal information, consent may be implied, or an "opt-out" method of consent may be used. Limiting Collection

The collection of personal information by The Royal Conservatory is limited to that which is necessary for the purposes identified by The Royal Conservatory. Personal information is collected by fair and lawful means.


Limiting Uses, Disclosure & Retention of Personal Information

The Royal Conservatory will not use or disclose personal information for purposes other than those for which it was collected, except with the consent of the individual or as required by law. Personal information will be retained only as long as required for the purposes identified in this Policy and/or at the point of collection.


Accuracy

The Royal Conservatory attempts to ensure that personal information is as accurate, complete and up-to-date as is necessary for the purposes for which it is being used. Please notify us of any change to your personal information by contacting us by e-mail at [email protected].


Safeguarding Information

Personal information is safeguarded by The Royal Conservatory through technological and other security safeguards appropriate to the sensitivity of the information.


Purchasing Online

The Royal Conservatory has contracts with third-party, on-line transaction specialists, through which your credit card information is secured. Encryption technology is used to ensure the safe collection and transfer of sensitive credit card information. Your personal credit card number is submitted to these on-line transaction specialists and not to The Royal Conservatory.


Openness

This Policy, as amended from time to time, will be available on The Royal Conservatory web site, or in printed form upon request.
 

Links to Other Sites

The Royal Conservatory web site may contain links to other web sites. The Royal Conservatory is not responsible for the privacy practices or the content of these other web sites and they are not subject to this Policy. The Royal Conservatory has no responsibility or liability for your use of any such web site.
 

Individual Access

Upon request, The Royal Conservatory will provide you with information on the existence, use and disclosure of your personal information. You may verify the accuracy and completeness of your information, and have it amended as appropriate by contacting us at [email protected].
 

Contact & Compliance

If you have any questions, concerns or complaints about privacy at The Royal Conservatory or in connection with this Policy, or if you would like to withdraw your consent to the use of your personal information, please contact The Royal Conservatory Chief Privacy Officer at [email protected]. The Royal Conservatory hours of operation are Monday to Friday, 9 a.m. to 5 p.m. (Eastern Time). Notwithstanding any withdrawal of consent, The Royal Conservatory will still be permitted to collect, retain, use and disclose personal information in order to collect payments of amounts owing to The Royal Conservatory and for its risk management and related purposes.
